Florida Bans Cultivated Meat

Neal Fortin finds Florida Senate Bill 1084 banning cultivated meat to be ripe for challenge.

Florida enacted law SB 1084 “prohibiting the manufacture for sale, sale, holding or offering for sale, or distribution of cultivated meat in this state.” Cultivated meat is defined as “any meat or food product produced from cultured animal cells."

The law raises interesting constitutional law questions, particularly preemption under the dormant Commerce Clause.

Governor Ron DeSantis said “Today, Florida is fighting back against the global elite’s plan to force the world to eat meat grown in a petri dish or bugs to achieve their authoritarian goals.” The mention of insect protein seems gratuitous because the new law doesn’t mention bugs.
